人間がパラシュートを使って他人の敷地内に無断で降下する行為は，刑法上の建造物侵入罪に該当し得る。しかし，降下中の者を猟銃を用いて射殺する行為は過剰防衛になるだろう。しかし，現行犯逮捕するために猟銃を発射して威嚇する行為は過剰防衛とはならないかもしれない。

では，ドローンはどうだろうか？

空中でも他人の所有物である以上は侵害することは許されない。ただ，物理的に管理可能性のない空間については土地所有者の支配が及ばないと考えるのが日本の通説だろうと思う（宇宙空間を含め，上空に無限に及ぶという学説もかつてはあった。）。

問題は，この物理的な管理可能性の理解に尽きると思う。電磁波によるジャミング装置は相当上空まで有効だろうと思われるので，それを用いて制御不能とし墜落させる行為は，正当防衛の範囲内にあると考えることもできる。要するに，電磁的手段の登場により，物理的な支配可能性のある空間的範囲がかなり拡大したと考えることができる。

このことは国有地や公有地でも基本的には変わらない。

ところで，民法を読めばすぐに理解できるとおり，日本の国土には無主の土地が存在しないことになっている。

その結果，玩具のドローンを飛行させようとする者は，自己の所有地（所有地がない場合には自己の居住する家屋内）においてのみ，それを飛行させる自由があるということになりそうだ。

ただ，物理的な支配可能性の意義及びその対象に関しては，議論すべき課題が山積している。

民法学者は明治時代以来，そのような基本的な部分に関する理論的検討をずっと怠り続けてきたので，現在の日本の民法学の中には全く使い物にならない法理論しかない。

たぶん，民法学者は，物体としての土地や空間や生物の本質を理解しようという努力を一切せず，世間話レベルでの幼稚な観念だけを所与の前提として民法理論を構築してきたのだと思う。しかし，そのような所与の前提なるものは空想の一種に過ぎないので，理論の大前提が空疎であり，理論体系全体が実は無意味なものとなってしまっていると言わざるを得ない。

民法の財産権に関する通説は根本部分から一旦廃棄して，全部つくりなおしたほうが良いと考えている。

民法学の中には適切な学説が全くない。ないものはない。仕方がないので，そういうことについても研究することにし，「艸－財産権としての植物」というタイトルで論文を執筆し，法律論叢誌上で連載を続けている。

佐野智也氏は，法情報学の分野における電子技術の応用において近年注目すべき研究成果を続々と発表している研究者の一人で，学会の際や電子メール等で意見交換をすることがしばしばある。この書籍を刊行するということは聞いていたので，刊行されたら購入して読んでみようと思っていた。昨日，会議を終えて帰宅したら届いていたのでざっと通読して感謝のメールを差し上げた。そのあとで，全体を精読した。

結論として，非常に有用性の高い書籍だと思う。

法情報論の分野では，主として法学教育分野での応用例ではかなり充実してきていると思うのだが，法学研究手段として法情報データベースを構築するという面では，通常の法令データベースや判例データベース等が主たるもので，立法事実に着目したビッグデータ的なデータベースの構築は不十分だと言える。かつてSHIPプロジェクトではそのようなものを目指し，技術的手段としてXMLの応用を考えていたのだけれども，研究予算が更新されなかったことと技術開発面の中心となっていた故小松弁護士の死去により，研究を頓挫せざるを得なかった。その当時蓄積しておいたデータの複製物は佐野氏に提供してある。是非ともこれを活用していただきたいと思っている。そして，立法事実を重視した法情報システム研究のエースとして，この分野の第一人者になってもらいたいものだと大いに期待するところだ。

本書においては，構築されたデータベースシステムを用いて，実際に民法（主として物権法）の立法沿革の研究にどのように応用可能かという実例が多数収録されている。法制史の学術面に関しては，帝国議会における議案説明書だけでは足りず，今後，当時のフランス民法と関連法令，当時のフランスにおける民法学説，ボアソナード独自の見解等に関して更にデータを蓄積し，縦横無尽に検索・調査できるようにすることが求められるだろうと思われるが，このことはデータベースを用いないで人間の法制史学者が研究する場合でも同じことなので，研究のための共通のプラットフォームとして立法沿革を重視したデータベースが存在し利用できることの意義は極めて大きいと思われる。

法情報学や法制史関連の研究者のみならず，広く知識工学や情報論と関連する分野の研究者には特にお勧めの一冊ではないかと思う。

痛みを感じることのできるロボット？

そもそも「感性」の本質についてよく考えてみる必要がある。

ある一群の反応のクラス（フレーム）を示すシンボル（符号）の一種として痛み等々の語が存在するという前提に立脚すれば，感性を記述することは可能だろうと思う。記述可能なものはロボットに組み込むことができる。

しかし，そもそも人間は語について共通理解をもつことはなく，共感することもできず，結果的に誰も「完全な会話」や「完全な意思疎通」を成立させることができない孤立した個体の集団だという前提にたつと，全く別の世界を描くことができる。

要するに，そもそもの大前提をどうとらえるかが大事で，そこらへんのことを曖昧なままにしているので，どうにも奇妙なことが発生するのだろうと推定している。曖昧にしている原因の一つとして，「『旧約聖書』の「創世記」にある記述は正しい」という大前提を決して動かさないという信念のようなものがあるのではないかと疑っている。

（余談）

一般に，フェア（fair）は「公正な」と訳されることが多いし，それでよいと思われるが，意味的には「社会的に許容された」という趣旨に理解すべきだろう。より適切な訳語があれば，修正するのが妥当と思われる。

一般論として，日本国の法学においては，「社会的に許容されていること」を正当事由（違法性阻却事由）とすることについての法学的研究成果が著しく乏しい。私の論説の中では既に何回か触れてきた問題なのだが，誰も書かないようなら私が論文を書いてしまおうかと思っている。

当たり前のことだと思う。基本的には文系の仕事だ。しかし，技術的知識のない者は担当できない。教養のない者はまるで資格がない。学歴や学位は基本的に全く関係がない。驚異的な読書量を誇り，優れた事務処理能力を有し，文系的な仕事と理系的な仕事のマルチタスクを合理的に処理できる者だけが担当すべきだろう。

ところが，現在の企業や官庁の人事システムや組織トップの意識はそのようにはなっていない。古代の律令制以前の状態と全然変わらない。だから，どうにもならない。

矢作俊彦・大友克洋『気分はもう戦争』（1982）という作品があり，かつて愛読したものだった。これは芸術作品の一種だ。しかし，リアルに，気分は既に戦争となっているような感じがする。

公海の範囲の認識についての重大な齟齬が国際的に厳然として存在している以上，また，「実効支配」は実力によって作り出されるものである以上，必然的な結果とも言える。

この場面でも，観念的な理知主義は機能せず，その有用性を喪失してしまう。

戦時と平時が常に共存する状況の下においては，不可避な事態だと考えるしかない。

（余談）

どのような議論も自由だし，女性という理由だけで教育や就職の機会を奪うことが憲法違反になるということを疑う者はいないだろう。

しかし，ヒトは所詮野獣がちょっとだけ進化した動物の一種に過ぎないという事実を無視すると（←米国の州の中にはダーウィン流の進化論を禁止しているところがあり，人間と野獣とは全く異なる存在だと固く信じている人々が多数存在することに留意しなければならない。），空理空論に陥る。

「理性」や「知性」といったような要素が完全に欠落している環境においても満足に機能するような理屈を考え出さすのでなければ，その理屈の有用性が保証されない。

このロボット警官は，武装しているようには見えない。

しかし，近い将来，武装したロボット警官やロボット憲兵のようなものが配備されるようになることはほぼ確実と思われる。

電磁的方法または生物化学的方法により，抵抗する人間や被疑者等を無力化することは容易にできるだろうし，そのような機能をもつロボット警官を製造することも容易なことだ。

ロボットカーではない普通の自動車でも電子制御されている部分がかなり多いので，単純な電磁波攻撃だけで制御装置を破壊したり操縦不能状態にすることが既に可能となっているし，現実にそのような事件が存在するかもしれない（警察にはそのような発想が全くないし，立証の方法もないので，その可能性を常に無視している。）。

今後，クラウドと電波で連動するような仕組みをもった自動車が増えると，自動車に対する攻撃ではなくサーバに対する攻撃によって無数の自動車を制御不能にしたりハイジャックしたりして，社会を崩壊させることが可能となるだろう。

人工知能型ロボットが普及する前に，現代社会は滅びるかもしれない。

こういう記事を読んでいると，日本国の政治家個人や都知事等の行動を外国政府が常時監視し，必要に応じてスキャンダル情報等を日本国のマスコミ等にそれとなく流して日本国の世論や政治動向に影響を与えることは可能なのではないかと考えてしまう。

例えばキリスト教における主流の考え方（モルモン教等を除く。）が消滅したとしたら，現在のような一夫一婦制を強制する倫理的根拠は何もなくなる。

つまり，一夫一婦制は，生物としてのヒトが本質的にもっている性質ではなく，一定の価値観に基づく単なる文化現象の一種に過ぎない。

現在のジェンダーの考え方の多くもそうで，文化的惰性または思考上の惰性のようなものを完全に消去してしまうと，全く異なる考え方も成立可能となる。

そういうことを考えてみることが大事で，過去の特定の価値観を固守している限り，学問上のブレークスルーはあり得ない。

昨晩もある会合で学問上のブレークスルーと関連した事柄が話題となった。

一般に、新たな発見や考案ができないのに単に非常に優れた秀才だというだけで権威をもち威張っており，真理を発見した若者を侮辱して真理が普及することを阻止しようとする人々が随所に存在しているのが普通だ。

昨晩意見交換をしていた某氏（←真の天才の一員だと思う。）も苦い思いを何度も経験しているとのことで，思わず握手をしてしまった。

しかし，秀才には決して新たな発見をしたり，新学説を打ち出したりすることは絶対にできない。それは，単なる秀才に過ぎないからだ。

秀才は公務員（官吏）や実務家になるべきで，学者になるべきではないと思う。

ちなみに，私自身は，学者としては三流未満でＢ級人間だと自認してはばからない。天才でも秀才でもないゆえ，平民としてコツコツと努力を積み重ねるのみ。

『万葉集』の挽歌の中にも同じような意味に解釈すべきものが含まれているように思う。平安時代以来，『万葉集』に収録された詩のもともとの意味が全くわからなくなり，和歌として誤解されてなされた解釈が通説として現在まで伝承されている例がある。このような場合，正しい解であるかどうかは別として，可能な解（仮説）のリストを自動生成するために人工知能を応用することは可能だと思われる。

自己の主観的感情だけに依拠してそれを他人に押し付けるようなものは，少なくとも学問としての「文学」ではない。

この記事に示されている解釈（英語訳）を冷静に読むと，『万葉集』の挽歌の中には非常に良く似た歌があるということに気づくことができる。

古代ギリシアの詩が西域を経てヘレニズム文化と一緒に日本国に伝来し，ソグド語（ペルシア語），サンスクリット語またはその漢音訳だったものが翻案されて『万葉集』に収録されたという可能性は否定されない。

日本の公道で同種の事故が発生した場合，自動運転自動車を保有して運行の用に供したというだけで運行供用者責任が発生すると思われる。

これとは別に，製造者の製造物責任も発生する。

また，「自動運転自動車を自動運転した場合には交通事故が発生する可能性があります」と明示して販売しない限り，販売店の法的責任も問題となり得るだろうと思う。「絶対に安全です」と宣伝する行為は，景品表示法違反行為となり得る。このような場合，アマメシバ事件と同様に，推奨する趣旨の論説を発表した博士や商業宣伝広告を掲載した雑誌社の責任も問題とされ得ることだろう。

法的責任を免れるためには，「安全です」とは決して言わないようにすべきだろうと思う。

抑留

私の叔父も蒙古抑留者だった。奇跡的に生還することができたが，よほど辛い日々を送ったのだろう，必ずしも長寿とは言えない人生だった。生前に頂戴した数珠だけが手元に残されている。

一般に，夢見物語しか知らない法律家であれば「正義に反する」というかもしれない。反対に，親ロシア的な学者は「当然の報いだ」と言うかもしれない・・・

観念としての「正義」は成立可能なのだが，それを実力でもって貫徹できないのであれば正義としての意味をもたない。

その意味では，現実の世界に「正義」はない。

人類が実現すべき目標はまだまだ遠い。

到達すべき「正義」のために少しでも近づこうとしている間に，別の要素によって人類は滅びようとしている。滅びる人類の中には，無論，ロシアや中国だけではなく，米国や英国も含まれる。

そうなることを知らないほうが幸せというものかもしれない。

一般に，世間では，少し間抜けなほうが幸福な人生を送ることができるようだ。

「歴史は繰り返す」というか・・・

古代にも似たようなことがあったと思われる。

しかし，それを口にすることははばかられる。

そういうものなのだろうと思う。

やれやれ・・・還付金

電子申告により確定申告をした。還付金があるはずだった。

ところが，本日に至るまで何の通知もない。

そこで，申告先の竜ケ崎税務署に問い合わせの電話をしてみた。

担当者によると，（理由は教えてもらえないが）本日付けで還付の処理がなされるとのこと。

通知書は本日付けで発送されるので来週には届くらしい。

送金処理は本日付けでするけれども，私の指定口座の三菱東京UFJ銀行の都合で４～５日しないと入金処理にならないかもしれないとのこと。

この時代にオンライ処理をして４～５日もかかるとは全くもって理解し難い部分があるが，田舎の支店から送金するとそういうことがあるのかもしれない。

田舎の税務署と銀行というものは随分とのんびりしたものだと思う。

田舎は良いところだ。

（余談）

政府（財務省）は，電子申告により確定申告をしても特にメリットはなく，自分で直接に問い合わせをしないといつまでたっても還付されないで放置されてしまうことがあるという警告文を掲示すべきではないかと思う。

口座残高を確認したところ，入金になっていた。

BIGLOBEのメールシステムには問題があるかもしれない

私は，BIGLOBEのメールアカウントを持っている。

さきほど，「ビッグローブ株式会社　BIGLOBEカスタマーサポート」というところから，「お客様が送信されたメールにウイルスがみつかりました。メールは送信されませんでした。」，「お客様のパソコンがウイルスに感染している恐れがあります。」との通知が届いた。メールの送信時刻は「Wed, 4 May 2016 05:09:56 +0900 (JST)」となっている。

しかし，私は，2016年5月4日（JST）には，どこからもただの1通のメールも送信していない。

この時間帯には，BIGLOBEのウェブメールサイトにログオンし，ウイルス付きメールと推定される見知らぬメール2通が届いているのを発見したことから，「迷惑メール通知」をクリックして消去した。

この事実から推定すると，セキュリティサイトに通知された「迷惑メール」にはマルウェアが感染していたということなのだろうと思う。「ビッグローブ株式会社　BIGLOBEカスタマーサポート」から届いた通知を丁寧に読んでみると，問題とされたメールの送信先が迷惑メール処理サイトだったようなので（問題のメールを自動的に転送するシステムらしい。），ほぼ間違いないように思う。

仮にそうだとすれば，「マルウェア除去にご協力ありがとうございました」との感謝のメールを送信するべきではなかろうか。反省と改善を求めたい。

もっとも，BIGLOBEに限らず，ウェブサービスの担当者が日本語や日本人の心を理解する者とは限らないどころか，実際には中国や韓国やフィリピン等で処理していることが少なくないので，どうしようもないことなのだが・・・

（余談）

BIGLOBEメールの「迷惑メール」対策を実施すると，問題のメールが本当にマルウェア感染している場合，転送途中で自動的に消去される仕組みになっているようなので，結局，迷惑メール処理サイトには届かない（つまり，真に問題とすべきメールが処理サイトに届くことはない）というかなり奇妙な仕組みだということを理解した。

[追記：2017年8月5日]

BIGLOBEの経営がNECからKDDIに移行したせいかどうか，メールシステムが一新され，全く別物となった。

問題は一応解消されたようだ。

IDやパスワードのような記憶されている符号の自白を強要することはできないが，生態認証の場合には強制執行の方法がある場合が多い。指紋にしろ光彩にしろ声紋にしろ，現在の刑事訴訟法によって強制執行可能だと考えられる。

つまり，生体認証要素の中には（法的な意味では）非常に弱いものがある。

技術者や数学者は法律家ではないし，まして企業家は利益のみを考慮に入れて判断するので，こういう問題に気づくことが滅多にない・・・というか，まずない。

それゆえ，私のように率直に意見を言う法律家は嫌な目で見られることが多い。身に染みてひどい思いをし，さんざん後悔するような出来事でもない限り，私の意見が実に正しいということを理解することはできないのだろう。それまで，ぐっとこらえて待ち続ける。

（余談）

かつて，東北大法学部の刑法教授だった荘子邦雄氏から「待つ。とにかく待つ。」ということを教えられたことがある。

私は東北大出身ではないのだが，なぜか荘子ゼミの卒業生で司法試験合格者が私のことを宴席のようなところに招いてくれたことがあり，そのときに教えられたものだった。

「待つ」ことにした。

じっと待っていても無為に過ごしていたのでは何も起きない。とにかく，環境が熟するまで，他人から馬鹿にされようが見下されようが嫌われようが全くおかまいなしに勉強を重ねてきた。

待った結果，うまくいったことが多々ある。そのようなうまくいった分野では既に誰にも負けることがない。後から追いかけようとする者は，私と同じように40年くらいの期間，ひたすら努力を重ねなければならない。

しかし，まだ待たなければならないことが多数残されている。

世間の人々が後悔の山を築き，私の見解を理解することのできるだけの環境が整うまでじっと待ち続ける。

そして，その間黙々と勉強を続ける。

現時点では誰も理解できないことなので，どこで勉強していても私が何を考えているのか誰にもわからない。私がどんな書籍を購入し，どんなものを読んでいるのかを知っても，なぜそのようにしているのかを理解することができない。

それでよいのだ。

「待つ。」
