基本的には，サイバー犯罪条約の刑事訴訟条項によって正当性（合法性）が認められていることを基礎としている。

空理空論に近いどこかの憲法学者の意見を聞いていても何の解決にもならない。

正しいサイバー法研究者としては，法源をきちんと整理し直し，米国の判例法を正確に理解し，丹念に検討した上で自論を展開すべきだろうと思う。

私自身は，現時点では立場上書けないこともあるので，書かない。
