学生にとっては高価な教科書が安く手に入ることは悪いことではない。しかし，教科書出版社や教科書の著者にとっては，悪夢としか言いようがない。
とは言っても，いずれ，電子出版による教科書出版が普通になるだろうし，その価格も日本円で１冊100円～500円くらいが相場になってしまうだろうから（←出版社や流通業者の人件費等を含め，流通経費をゼロに計上すれば，当然に実現しそうな価格），こうした問題が発生する社会的基盤それ自体がそもそも消滅してしまうのではないかと予測している。

日本の自治体でも同じだと思う。
「業務の電子化はコスト削減どころか赤字の増大につながることがある」という点については，そのメカニズム及び解決策を含め，明治大学の講義等で何度も触れてきたことなのだが，いまいちピンと来ない受講者が多いようだ。
一般に，自分にとって都合のよいことしか理解しようとせず，都合の悪いことには目を瞑って何も対処しようとしない場合，結果的には最悪となることが多い。

そのメカニズムについては，必要のある部署に対して既に説明してある。
人間の先入観のようなものを利用した手口であり，かつ，証拠を残さないようにすることが可能な手口なので非常に厄介だ。しかも，その解決のためにはかなり厳しい問題を乗り越えなければならないことになるかもしれない。
あとは，政策決定者の決断次第だ。
ただし，ひとくちに情報セキュリティ専門家といっても様々なタイプの者がある。その中で，知名度や経歴等とは全く無関係に，本当は並の能力しかない者に任せていると，やはり失敗することになる。
一般に，考える能力と実行する能力とは，基本的に異なる能力だ。それらが同時に共存している真に天才的な者も全くいないではないが，普通の者はそうではないという謙虚な気持ちをもつことが大事だと思う。
そして，異なる能力を持つ者を集め，共同作業でことにあたらなければ必ず失敗する。

ちなみに，行動履歴を追跡されているのが普通なので，自分の趣味嗜好とは全く関係のないサイトやコンテンツに意識的にアクセスし，個人プロフィールの自動生成に大混乱を与えるようにすることも非常に重要なことだ。要するに，推理させないための煙幕を目いっぱい充満させるということに尽きる。お金のかからないやり方なので，誰にでもできる。
実は，ネット上のバーチャル社会だけではなく，現実社会においても同じようなことが言えると考えている。

日本でも，スーパーマーケットなどで簡易なカード決済手段がどんどん導入されている。試しに私も何度か使ってみた。
やはり不安が残る。
たぶん，潜在的には既に情報漏えいが発生しているのではないかと思う。
なぜなら，設置環境や運用環境等を丁寧に観察してみると，かなり駄目な状況にあるのが一般的だからだ。

日本の場合，警察を含め，政府関連サイトが攻撃を受けたことが何度もあるし，機密情報を外部に流した可能性のある秘密の物理ケーブルが密かに設置され外部に出ているのが発見されたこともある。
警察のサイトの重要部分がハックされた場合，たとえば，捜査官しか知らない秘密情報を含む文書等が作成され，真実は犯人でないのに「秘密の暴露」を含む犯行の告白をするといったようなことが（少なくとも理論的には）可能となる。
このことは，刑事事件（特にサイバー犯罪）の捜査に関する基本的な考え方に大きな修正を要求するものだ。
私は，この分野についてもずっと研究を進めているが，研究の根幹部分を構成する基礎的研究に随分と時間をかけてきたし，まずその研究成果を何らかのかたちで公表することが先決であり，そして，目下のところ他の仕事で繁忙であることやかなりひどい資金不足に陥っていることなどから，サイバー犯罪捜査に関する研究成果を論文のかたちで公けにするのは早くても来年以降になるだろうと思う。

いろいろと議論を読んでいるし，今後もっと議論を呼ぶことになるだろう。
この胚が順調に成長し，普通のヒトとして成長した場合，もし遺伝子によって個体識別するとすれば，その「個体」は３名と数えるべきだろう。しかし，どう観ても１名にしか見えないから，マルチモーダルによる個体識別という方法は，理論的にも現実にも完全に破綻したと断定することができる。
つまり，技術の進歩により，ヒトの個体識別手段が喪失してしまったというのが現在の状況であると判断することができる。
個体識別は，全ての法制度の基幹部分を構成する重要な要素のひとつなので，既存の法哲学や法解釈学も基本的に崩壊したと考えて良い（もっとも，子は両親の遺伝子の自然合成物であるのが普通であるので，遺伝子だけをみた場合，独立の個人として考えることが最初から間違っていたというアプローチも可能で，現に，日本を含む世界各国の法定相続制度はそのような考え方を基盤にしなければ理解し難い。換言すると，法制度全体をみわたすと，かなり基本的な部分で自己矛盾を含む法制度を構築してしまっており，法制度全体としては内部的な整合性がとれていないのだ。）。
私は，普通の法理論体系とは異なるまったく別のアプローチで新たな法体理論系を模索し，研究し続けている。ただし，誰もスポンサーになってくれないので，資金不足により，研究の進展・速度は極めて遅い。加えて，誰も理解してくれない（←理解できそうにない，または，理解できても賛同してもらえそうにないという場合を含む。）。

私の推測では，処理の過重によるものではないかと思う。クラウドでは，いかに高性能マシンとはいえ，全ての処理が１箇所のマシンに集中してしまうため，たまたま処理量が溢れるとトラブルを起こす。システムアーキテクチャにもよるが，負荷の過重に弱いという脆弱性があるという点では，普通の分散システムよりも弱いものだと理解することができる。
そのことから，将来的には，専らクラウドサーバを狙った特殊なDoS攻撃（DDoS攻撃）手法が開発され実行されることになるだろうと予測される。

日本の法律で言えば電気通信事業法を適用すると言っているのと同じことになる。つまり，「通信の秘密」に対する侵害罪が成立し得るということになる。

ビッグデータのビジネスは，かくも違法だということを如実に示す一例と言えるだろう。日本では，法規範を無視してビッグデータ礼賛のような姿勢を示す馬鹿者が多過ぎる。
なお，データを匿名化（例：氏名を形式的な符号に置き換える処理など）をしても，実は個人データの属性を失うことがなく，匿名化が匿名化にならない例について，先週の法科大学院の講義で説明したのだが，学生が理解してくれたかどうかは分からない。その理解のためには，ある程度数学的センス（←算数能力ではない。）が要求されるので，そのようなセンスをもっていない学生には無理かもしれないと半分諦めながら，たとえ一人でも私の言うことを理解してくれる学生がいれば，将来，法律家として正しい思考をすることができるようになってくれることだろうと期待して講義を続けている。

ちなみに，同種の攻撃は，人間にインプラントされているほぼ全ての電子機器についても同様に可能だと思われる。
また，電子装置を組み込んだ機械装置の非常に多くは電磁波攻撃に弱い。簡単にハックまたは破壊してしまうことができる。そのような機械装置には，通常の電子機器類だけではなく，病院内にある各種検査・治療用器具のほぼ全部が含まれる。電気や水道などのインフラプラント制御用機器類もまた同じ。
現代社会は，とんでもなく脆弱な基盤の上に成立している。

企業の社会的責任を軽視し，利益増大を重視し過ぎると，要するに手抜きとなるので，この種の事故が発生しやすい。
まじめに仕事をしようとするとそれなりにコストが発生するので安い値段で製品やサービスを提供することができない。
「安いことは良いことだ」と考えること自体に見直しが求められるべきであり，同様の理由により，とにかく安い入札者に仕事が回ってしまう現在の入札制度にも根本的な欠陥がある。現実に，仕事を仕上げることができない，または，欠陥や手抜きが後から見つかるといった事故が相次いでいる。
良い製品や良いサービスは，提供するためにそれなりのコストがかかるので，相応の対価の支払が必要となる。
「安かろう悪かろう」が正しい。

「第３次世界大戦」という表現はちょっとどうかと思うが・・・
正確には，「第１次世界大戦以降，世界は継続して戦争状態にあった」とみるほうが良いのではないかと思われる。つまり，外見では平時のように見えても本当はずっと戦争が継続していたと考えるべきではないかと思われるのだ。
さて，米国の仮想敵（または現実の敵）は，誰になるのだろうか？
主権国家だけを考えている限り，正しいものの見方をしているとはいえないというのが私見だ。
主権国家というものは，人類の歴史上，一時期だけ生じた過渡的な現象の一つだと理解したほうが良いと考える。
絶対的なものではないし，永遠に続くものでもない。

端末側に記録されるCookieによる行動追跡がまだまだあるのは事実だ。
しかし，Cookie以外の手段による場合がいくらでもある。例えば，パブリククラウド環境では，サーバ側で一網打尽に全利益を取ってしまうやり方が普通になっている。だから，Cookieだけを規制しても意味がないのではないかと思う。

要するに，「割符」であり，相当昔から私が提唱してきたものだ。
電子文書では既にNTTなどが開発した技術が応用され実用化されている。
パスワードのような非常に短い符号列において単純に理論を応用しても効果的に利用可能な技術となるかどうかについては疑問があるが，まあとにかく，何らかの技術的手段を加味することにより，実用化にまで至ったということなのだろう。

真相の解明が待たれる。
さて，ここまでは検察官や裁判官も理解可能な範囲内だろうと思う。
しかし，真の問題は，すでに思念コントロール兵器が存在するということだ。この兵器によって支配された者には自由意思などない。けれども，検察官や裁判官が理解するとは思われない。しかも，証拠が何も残らないので，弁護人（弁護士）としても手も足も出ない。かくして，思念を支配された被害者であるはずの者が加害者として処罰されることになる。
このような問題を考える場合のポイントは一つしかない。
それは，「人間は装置の一種である」と思うことができるかどうかに尽きる。
もちろん，宗教上の理由その他の理由により，そのように理解することそれ自体が許されないことはあるだろう。
しかし，事実は事実として認めざるを得ないし，そうしなければ問題を解決することができない。

（余談）
私がコンピュータ法（現在のサイバー法）の世界に首をつっこむことになった約30年前，すでにコンピュータウイルスは存在していたが，他人の電子計算機を完全の乗っ取るようなタイプのマルウェアがあるとは誰も考えていなかったし，誰も実現可能だとは思っていなかった。
だから，私がそのような未来を説明してみても，「それはSFだろ？」と笑われるのがせいぜいで，誰も信じてくれなかった。
結局，そのような経営者の無知または傲慢とエンジニアの自信過剰が現在の状況を生む結果となってしまったのだろうと思う。
「素人」の中には「専門家」よりも能力的にはるかに優れた人材がいくらでもいる。自分の能力をもってしては全力を尽くしても全く太刀打ちできない誰かが多数存在するのだ。そのような謙虚な気持ちをもってマネジメントを考えていれば，別の未来があったかもしれない。
現在，私は，電子計算機ではなく生体の脳を乗っ取ることが可能だと主張しているし，現実にそのための手段（サイバー兵器）が既に存在している。しかし，誰も信じない。
これでは30年前とまるで同じだ。
なぜ学習しようとしないのだろうか？
結局，世間の指導的立場にある人々が無能であり傲慢であり自信過剰でありながら，欲望にまみれ，その地位を捨てることが決してないので，こういうことになるのだろう。
こんな状態が続いていると，いつか社会が耐え切れなくなる。ある種の「浄化」を伴うような極めてシビアな政治的事態が発生することになるかもしれない。
かつてのような物理的な処刑を伴う革命でなくても，社会的な地位の喪失や追放を伴う大規模な政治的変化は，現実にあり得ることだと考えている。

情報セキュリティについては，理系のエンジニアだけの領分だと誤解する者がかなり多く，このことが日本の情報セキュリティの確保の上でも深刻な問題となっている。実は，このことこそが最大の脅威となっているのかもしれない。
そもそも，初等教育～中等教育の段階で，「文系」と「理系」に２分してしまうような教育システム（国家政策）それ自体が根本から誤っているのだ。
分野を問わず，優れた人材は優れた人材だし，そうでない者はそうでない。ただそれだけのことだ。こういう簡単なことを理解・承認する能力を欠く者のことを，世間は「馬鹿」と呼ぶ。

他人のリソースを他人に転売する行為は適法だ。そうでなければ，ほとんど全てのビジネスが違法行為となってしまう。人間の社会生活は莫大な数の再販売の連鎖の上に成立している。流通過程そのものが再販売の連鎖として理解すべきものなので，再販売それ自体を違法とすることはできない。
音楽を記録した物体としてのLPやCDでも同じで，買取形式での流通は再販売の連鎖として理解するしかない。
したがって，音楽産業においても，再販売は適法でなければならない。
問題は，デジタルコンテンツの場合，再販売しても記録が販売者の手元に残るということだ。これは，新たに複製物を生産し，その生産物を販売する行為として理解することができる。そして，その複製物は無限に生産可能であるため，最初にコンテンツを生産した者は多額の費用を支出しているのに複製物の生産者はコストゼロで複製物を大量生産可能であり，正義に反するという観念が生ずることになる。
結局，音源の記録手段を普及させると必然的に発生する事象なので，社会状況の変化に伴い，「記録」を商品とするビジネスそれ自体が社会的に成立しなくなるという歴史的過程の中で我々は生きているのかもしれない。デジタル化技術は，人間の社会の中の「ある産業」を壊滅させる力を持っている。当初は，非常に高価な技術であったため，音楽産業しか利用することができなかったかもしれないが，いまや誰でも利用可能な普通の技術になってしまったので，必然的に音楽産業も存立基盤を失ってしまうことになる。
このような変化に対する対応には様々なものが考えられる。
私見としては，本来であれば「不正競争防止法の問題」として理解し対処すべき問題を，「著作権の問題」に置き換えて理解し対処しようとするから，結果的に妙なことになってしまうのではないかと思っている。
どちらにしても，「記録」の複製・販売をコアとするビジネスモデルはますますもって存立基盤を失うことになるだろう。少なくとも複製の「記録」によって大きな利益を得ることのできる時代は去った。
（当然のことながら）複製物の再販売ビジネスも成立しなくなるか，または，少なくとも利益を生むことができなくなる。
その本質は，誰でも「記録」することができるということに尽きる。
ちなみに，量子コンピュータの技術を応用すれば，複製し送信したとたんに元のファイルが完全に消滅するような「物体」の再販売に似た世界を構築することが可能だろうと思う。しかし，その場合でも，そのファイルを演奏させる（音としてスピーカーを振動させる）のでなければ音楽ファイルとしては無意味になるので，そのような音を新たに「記録」することは可能だ。つまり，何らかの記録装置がある限り，複製と再販売を技術的に阻止することは絶対に無理という結論になる。つまり，デジタルコンテンツに関する限り，（理論的には）ビジネスモデルの大半が（収益モデルとしては）最初から成立しないものだったと理解すべきことになるだろうと思う。

日本でも，企業や大学等のPCでリース物件であるものがかなり多数あるから，その中には同種または類似のスパイウェアがインストールされている可能性が全くないとは言えない。

かつてはマザーボード上に配置されていた各種部品が１個のチップに全部集約されてしまう時代がいよいよ近づいたと言える。
いずれ，マザーボードという概念が消失し，マザーチップになることだろう。
もちろん，ブレードコンピュータも消え去る。
１チップになった超小型コンピュータを複数個立体配置したようなデバイスが一般的となると予測している。その大きさは，どんどん小さくなり，基本的には角砂糖サイズでおさまる。

以下は，あくまでも一般論だ。
政府が保有する国民の個人データを商業利用したいという欲望は常にある。
なにしろ，政府による収集行為は税金によって賄われているので，それをそっくりそのまま頂戴できれば，コストゼロで莫大な分量の個人データを入手することができる。
実際には，普通の企業にとってはそれを入手したところでほとんど役にたたないのだが，ヤクザを含め違法行為をビジネスのコアとする企業にとってはとても美味しい情報ということになる。特に恐喝的なビジネスや詐欺的なビジネスにとっては大変なごちそうとなるだろうということはほとんど疑うべき余地がない。

現時点で，一般向けの３Dプリンタでは簡単なものしか製造できない。しかし，工業用または軍事用の高性能の３Dプリンタでは（正確には，様々な方式のもが存在するが）ミクロン単位での立体加工が可能となっている。
このことから，今後，精密金型なしに超精密な電子部品や各種部品等が安価に大量生産できるようになるだろうと思われる。しかも，最初から人件費が全くかからない方法なので，例えば低賃金の国に工場を建築して人件費を抑制する必要が全くなくなる。むしろ，地政学的なリスクだけを考慮にいれて工場の立地計画を考えることが可能となる。その結果，多くの米国企業の工場が米国内に戻ってくるという現象が発生することになるかもしれない。ただし，その場合でも，雇用の拡大にはあまりつながらない。なにしろ，人間の労働者を基本的必要としないからだ。

被告は，自分の管理下にない者がやったことだと主張していたようだが，「それではなぜ被告が収益をあげているのか」を説明できないので，主張自体失当というべきだろう。
また，従業員が勝手にやったことだったとしても，経営者として適法に管理していないことそれ自体が責任原因となることが明らかなので，これまた主張自体失当となる。
要するに，違法行為によって金儲けをすることは許されない。

ちなみに，私のブログや著述もかなりパクられている。
他人の著作に対して「敬意を表する」という気持ちがないことと，「ばれないだろう」という安易な予測がそういうことをさせているのだろう。
馬鹿だ。
明治大学での昨日の講義ではそれに関連する話しをした。「事実」としての他人の著作の「存在」それ自体と，存在する他人の著作を自分が読んで理解した内容（＝解釈）とは全く異なるものだ。そういうことをきちんと学生に理解させたい。
どこの大学とは言わないが（←明治大学ではない。），そういうことをきちんと理解していない教員が安易に学位論文作成支援システムのようなものなどを構築・運用してしまうものだから，盗作または剽窃として後で問題となるような事例が多発している。憂慮すべきことなのだが，当大学の現学長がそういうことを推進しているものだからどうにもならない。ここでもまた「トップが悪である場合」の問題が顕在化していると言える。

そして，その後，１人の独裁者が無数のロボコップ軍団によって，その独裁者以外の人間全てに対する支配を確立することができるだろう。
ちなみに，地球上の人間のほとんど全員はロボットに仕事を奪われて失業者になる可能性がある。失業した人間は，生きている価値がないものとして扱われ，ロボコップによって捕獲された後，どんどん処分されてしまう可能性はある。

なお，ここに書かれていることは，理論的にはウィーナーの『サイバネティクス』の域を全く出ていない。むしろ，常識に属する。
意味があるのは，理論の検証が進んできたという点に尽きる。
それはさておき，現実問題として，人間の「発明」の多くは単なる「発見」であるか「模倣」であるかのどちらかであり，本当の意味での「発明」は稀有に属する。
そして，本当の意味での「発明」はずるい人々に奪われてしまうことが圧倒的に多いので，真に優れた者が豊かな生活をすることができるようになることは，これまた稀有に属する。

完全に日本悪者論なのだが，正確には，日本の著作権管理団体が邪悪だという報道であり，日本政府は国民や専門家等の意見を無視しているという批判記事だ。
著作権法を改正し，大幅に非犯罪化の方向を打ち出すべきだろう。本来的には刑事処罰によってではなく民事訴訟によって解決すべき事柄ばかりだ。著作権管理団体だけを特別に保護し権限を与えるべき理由など何もない。
また，政府は，ACTAなどが世界の趨勢だという誤導を今でも続けている。こういうどこかの国の三流広告代理店でさえもやらないような嘘つき扇動はやめにしてほしい。
「日本は孤立している」と正しく広報すべきだ。
